    It looks like this thread has really started to make peope think of the "status issues".

    A lot of people have sent me PM's to assist them. However; I can't take this off-line; therefore, please resist from sending me PM's.

    Reason I participated in this discussion was to highlight some of the things that people should think of and determine best courses of actions.

    attornies and the like are very busy doing their current work. There is a high chance that they may not do the proper due diligence or ask you the proper questions before they file.

    You all need to have a very thorough discussion with your attornies and take second opinions where necessary. I can tell you that depending on your attornies case load; how many phone calls they are taking; they may provide you advice that would suit their own needs (ie., get you off the phone the quickest and let them carry on with their normal duties).

    Unless the law changes; everyone will be stuck in retrogression for a long time. If UScis should pre-adudicate and deny 485's then you will lose the opportunity to re-file for quite some time.

    This is an important topic as this is what uscis mainly looks at in the 485 stage. I suggest people discuss it with their attornies and make sure you have every situation covered before you file the 485.

    Asain-Americans seems to favor Obama overwhelmingly as per this survey. its interesting to read the survey - these immigrants who have gone thru the process themselves and might have friends/relatives in the process - didnt mention immigration as one of their important topic to decide on the vote. Understandably economy is the top topic but was expecting to see immigration atleast behind economy.

    Just fyi Rolling Flood and me are two different persons but must say your logic is compelling.
    To me the whole system is unfair. Brilliant guys like you , who are authority in their field suffers, where as small timers who came here through a body shop get themselves in EB2 category because of twisted rules and laws get the most coveted green card much earlier than you.
    All these are frustating.

    Fighting system is one thing and protecting what is with in the reach is other.



    Rolling_Flood, great idea to benefit just U'r own GC cause. If you are positive about U'r logic why don't you go ahead and file a lawsuit. Looks like your true intention of creating this thread is to create a divide among IV members. Already members had a tough few weeks (in terms of unity) after the Aug bulletin. Now you are poking another rift.

    The EB classification is for a future job. Since the person is qualified, he ports to EB2 midway so what. The GC is for a future job, and when the person gets his/her GC, he/she is qualified for that position at that time. So what is U'r logic??


    If you want to truly fight the system them fight for a common basis for EB classification. There are cases where the same job title has been classified under all 3 categories. Example

    Senior Programmer (say Bachelor's with 5 yrs exp)

    Files under EB1 : because he/she came L1, qualification might be few yrs exp.
    Files under EB2 : because he/she has 5 yrs of exp and the attorney was smart to classify it as EB2.
    Files under EB3 : because of company policy or based on bad attorney advice (conservative approach).

    The above example shows that if U'r company and attorney is smart U can get U'r GC faster.

    If you are keen on doing a lawsuit why not
    File one against USCIS for wasting thousands of visa's over the past few years, which is the source of this backlog.
    Or file one against DOL for taking n number of years to get the LC done.
    Or file one against 245 filers who clogged the USCIS system which is causing USCIS to be inefficient.

    Although the discussion has deteriorated to a point where it will not be healthy anymore, these are valid questions.

    I think a good compromise would be if interfiling is allowed only if the candidate was eligible for the EB2 position at the time of filing the EB3 labor. The current rule punishes those who go to grad school full-time, especially if you did a PhD but do not qualify for EB1.

    I do agree that points raised by Rolling Flood is not well received by most in this forum.But I would pray that no one gets personal and keep the exchanges healthy.

    I do feel that this porting rule is a double edged sword with both pros and cons.But the question is : is it flawed enough to scrapped??

    I must add though, I see were Rolling flood is coming from.Just consider this scenario: Two guyz A&B graduate with a Bachelors degree at the same time.A decides to pursue higher studies and B takes up a job. After a year they file for B' EB3 at his work, while A is still at school.By the time A graduates and a EB2 is filed for him , B is also eligible for EB2.But here is the catch,B gets a much earlier PD than A.So was A a dumb dude that he decided to go to grad school.Does academic experience count for nothing against work experience???

    Guys,

    Draft of this letter itself is an invitation for the investigation into Labor certification process for the individual who are suggesting they were qualified as EB-2, but their attorneys or HR reps told them to file under EB-3.

    Entire LC process is certified under the assumption that the employer in good faith has tried to hire US citizen and since he couldnt find a qualified US citizen for a that Job position, the employer is hiring an alien ( foreign national).

    I am not supporting this petition, even though i am a victim of the backlog centres and my labor took 4+ years for approval.

    We should all support IV's initiative for recapturing of wasted VISA numbers from the past years.

    Fighting among indian EB-2 and EB-3 is useless and it defeats the purpose of IV unity.

    IV seniours should immediately intervene in this matter and stop further discussions on this useless petition which doesnt have any legal standings and in itself is an invitation from DoL and USCIS to investigate the individuals who signed the petition and messed up their immigration process.

    awaiting I-485 approval...which will be 2-3 yrs down the road, if no relief from US congress.

    Right now enjoying the freedom using EAD.

    I have my disagreements with the letter content and have let it known in my posts on the thread.

    Pani you are an old IV member with IV experience and I trust that you would give second thoughts based on my comments.

    Lets petition USCIS to scrap EB3 and send them home. Rolling_flood needs his GC real bad... We are unavailable today and will be U in 2010. you can have our 3k visa for your category.

    We see it all the time, people will find ways to move ahead and so will you..nothing wrong with that. What is wrong is demeaning or ridiculing a group for you selfish needs...good luck with the law suit.. the least it will do is highlight problem our to a greater audience (Y).

    is there a website/magazine where i can get list of foreclosed properties?

    Google will find you plenty but they charge money. I search real estate through ziprealty.com. It's free. It doesn't specifically mark the foreclosed properties. However, there're a few ways you can find if a property is foreclosed:
    Some properties are listed as bank-owned in the description. they're foreclosed.
    Some properties say "pre-approval" required with offer. That's -likely to be (75% of the time) a foreclosed property.
    Banks reduce price of property at a consistent basis (say reduce by 20K in the second week of every month). The website I mentioned has a history of price drop of all properties.
    If a property is offered As-Is, it's likely to be foreclosed.
    If you want to double check, goto the municipalities web-site, most of them have owner's information of all properties on their websites. If the owner is a bank, it's a foreclosed property.
    Look for a combination of the above factors to identify a bank-owned/foreclosed property.

    If you did not like EB3 and felt you are worthy of EB2, they why did you not fight with your HR and Lawyer?
    Why do you want to accuse DOL for the mistakes of your HR and Lawyer. Why don't you write this 'from your heart' letter to your HR and lawyer first? and sue them?


    Agree. Qualifying in a particular category is an individual problem. It cannot be generalized or taken for granted. It is your responsibility to take up the issue individually if you think you are EB2 OR EB1

    I was schocked to find out on Sep 22 that my I-485 has been denied. My wife is on AP and can't enter U.S now withot her H4.

    Sorry to know your troubles. I am curious about the reason for 485 rejection and how you are going about it (is it because of using AC21 and I140 revocation by previous employer?) - there is an effort to deal with I-485 rejections without NOID - there is a separate thread on that with conf call today.     As much as terrorism is an evil thing, surgical strikes and stuff won't do crap. It will further alienate and give fodder to the mullahs to create more Kasab's. Really, do you think we can stop 20 yr old guys who are willing to kill themselves, think again? These guys are just washed out completely, there is no retribution, pain, all they see is a target and blow themselves out.

    Instead, we should concentrate on the war within that we face. Be it from communal/political/socio-economic violence or lack of regard for the common man's life. By no means I am saying inaction but war is certainly not the solution. Pakistan will meet its fate sooner than later if they continue the path they have chosen. We don't have to hasten it.

    ca_immigrant, you have brought up good points and the sophisticated rent vs buy calculators are available online for free which anyone can run math in 10 mins. Rents are holding steady in CA, so calculations might play a bit differently in CA.

    First of all, 5% is not available today for 30 yr fixed, its more like 5.25%. Another attractive option could be 5 year ARM or 7 year ARM if you can make additional payments for the principal, it will significantly bring down the principal amount owed at the end of first 5 years if you make CONSISTENT (per month) additional payments.

    I live in WA, I searched MLS & zillow for recently sold homes, most homes are going for 15-20% less than owner asked priced. Avg 3 bedroom house price here is 500K.

    1. I do not qualify for tax rebate offered this year due to income level restrictions (spouse works)
    2. Rents in Seattle have fallen steeply. Last year (aug), I was searching for apartment, I was offered at 1600 or 1700. The same apartment is now going for 1450. Some have fallen more steeply upto 1200 of the same class. I can get a very good/posh 2 bedroom apt for 1050 USD per month in today's date if I move out 5 miles more. It was unthinkable in seattle area 1 yr back.

    As you said, monthly payment on a 500 K house comes to around 2750 USD, thats true even in seattle. Thats 1750 USD more than the rent or atleast 1500 USD more than the rent.

    The gamble would be to stay in 1050 rent house for 2 more years and save bigger nest for downpayment. And prepare for the prices to fall more. say 25% more.

    Even if I offer current owners 20% less , the math does not make sense for me. Hence I am expecting 30% -35% correction from current expectations of the owners.

    Dont get me wrong, the owners would still be making a profit on homes constructed before 2003 even if there were 30% more correction.

    One thing we all know for sure is , home prices are not about to go up spectacularly. Maybe 30-40 K up in 2 years from now. When you are thinking of 10-20 year deals, thats not a lot, its peanuts :)

    As of now, I am thinking of buying a nice car instead of a house, since I can talk down car owners equally and since my GC is in geopardy, buying a car for now makes better sense. :)

    As someone said we should consider luxury of a house. I have rented one townhome for 1500 a month for which my neighbour is making 2800 USD payment, go figure :)

    Like me, there may be many IV members who work at a place where there are small fraction of employees on H1. As an example, where I work, out of 70 employees 3 employees are on H1b, including myself. With this proposed bill, each such employer runs into the risk of being picked up for investigations and audits. If the employers have to go through the hassle and inconvenience of federal investigations from two federal agencies, I am not sure how many employers will continue to keep employees on H1. So this bill will not just hurt the consulting company employees, but it could potentially cause lot of problems for other employers too.

    If you want to buy a home after you get your green card, mostly you will get after your retirement.

    I don't want to feel "my home" when I am 68 and after my kids are out on their own. So I decided, dump the H1B, H4, 485, 131, 761, 797, 999, 888, I94, EAD, AP... AAD, CCD etc crap in trash, and bought the home.

    I am happy. Even if I am asked to leave the country tomorrow, I just lock the door, throw the keys in trash and take off.

    who cares when life matters.Exactly.Thats the way i think too.We might be spending an additional 500 on a mortgage But we get better comforts.Spending a good paortion of your age without comforts which ypou are eligible doesnt make sense.And if something fails let the bank have it.After all we spent Rs.20000 PM for additional comfort.

    Its a problem when we dont speak out on our issues - nobody understands our pain

    Its a problem when we speak out on our issues - USCIS is offended that we have issues and wants to come hard on us.

    What do we do? I am fine with USCIS rejecting or approving my application but reject it or approve it without putting me on hold for 10 years. Is that too much to ask?

    It is the resume fakers and document fakers and the rule breakers who should be afraid of reaching out to people. The reason why we are in the mess is because of the greedy employers and ignorant and equally greedy employees. Corporate Greed brought America down.

    Do you guys look around at all of immigration.

    EB people are generally the only non immigrant to immigratn class of people who are allowed to stay in USA while they wait for greencard.

    Almost all others have to wait outside USA for many years and cannot take benefit of what this country has to offer.

    You could be a phillipino brother/sister of US citizen and wait 23 years to get your number called.

    You could be here from Liberia as temporary resident for the last 20 years and have to keep getting extensions for temporary status and one day it gets taken away from you.

    Sorry to tell you but the way you guys define pain is not pain when it comes to most immigration matters when compares overall.

    Charities are sweet things, but Gary D. Bass wants them to get rough and tumble when it comes to dealing with government.

    In his new book, "Seen But Not Heard: Strengthening Nonprofit Advocacy," Bass and three co-authors argue that charities need to lobby more often and more effectively. "Democracy would be better off," said Bass, executive director of OMB Watch, a nonprofit group that pushes for government accountability.

    Most people -- and, clearly, most charities -- think of lobbyists as corporate frontmen trying to grab taxpayer largesse for themselves. They also consider lobbying kind of dirty, given the criminality of infamous lobbyists such as the now-imprisoned Jack Abramoff.

    But lobbyists come in all shapes and sizes, including the charitable sort. Bass's book, which is part of a larger effort called the Strengthening Nonprofit Advocacy Project, or SNAP, is a useful reminder of that.

    Bass has been trying to convince charities for years that they should not be afraid to lobby. He and others, including the Center for Lobbying in the Public Interest, have even devised ways to ease -- or at least simplify -- the limitations now imposed on charities so they can press their causes more aggressively.

    That's right, they are lobbying to be allowed to lobby more.

    Conservative lawmakers and a few campaign-finance scholars don't like the idea. They worry that, among other things, the ability of charities to keep their donors anonymous could lead to huge and largely untraceable infusions of cash into elections, all under the guise of lobbying.

    And please, call it advocacy. Charities don't like to use the "L" word. Only a third of nonprofits polled recently owned up to "lobbying" two or more times a month. But when asked if they "advocate," closer to half admitted to that.

    Many nonprofits also are unsure how much lobbying the law permits them to do. Only 72 percent even knew that they could support or oppose federal legislation. (They can, up to a point.)

    Bass's biggest problem is convincing charities that they not only can make their case to government, but that they really ought to do so . In effect, he needs to convince his fellow do-gooders that lobbying is not so bad.

    "Nonprofit lobbyists have been involved in nearly every major public policy accomplishment in this country -- from civil rights to environmental protection to health care," Bass said in an e-mail. "Tens of thousands of lives have been saved by passing laws that improve car safety and reduce drunk driving."

    "In other words, nonprofit lobbying is an honorable tradition," he added, "and not just the ugly Abramoff side" of the profession.

    Convincing charities of that, however, will not be a snap.

    As long as the employer/employee relationship exists, an H-1B alien is still in status. An H-1B alien may work in full or part-time employment and remain in status. An H-1B alien may also be on vacation, sick/maternity/paternity leave, on strike, or otherwise inactive without affecting his or her status.

    Honestly; uscis/dos don't care much for this. Maternity is a pretty good reason and is verifiable.

    Other then that; department of state; uscis don't care for it much. They have enough data on companies that if it happened to a person in one quarter then ok. However, if there are a number of people who fit the profile then it gives less credibility.

    I'll give you an example: DOL comes to investigate a particular person whom DOS has referred. Now; they go through the whole list of people (they actually do this); and see that every person who arrived into the country was on bench for three months...gives less credibility to the person's argument.

    WASHINGTON -- U.S. House members spent $20.3 million in tax money last year to send constituents what's often the government equivalent of junk mail _ meeting announcements, tips on car care and job interviews, surveys on public policy and just plain bragging.

    They sent nearly 116 million pieces of mail in all, many of them glossy productions filled with flattering photos and lists of the latest roads and bridges the lawmaker has brought home to the district, an Associated Press review of public records shows.

    Some offered advice on topics one would more commonly expect to see in a consumer-advice column.

    "Keep your car properly maintained" to improve mileage, suggested Rep. Tim Murphy, R-Pa., in a newsletter on how to deal with rising energy prices.

    Rep. David Dreier, R-Calif., offered tips on home improvements.

    And Rep. Cynthia McKinney, D-Ga., who lost her primary race last year, sent out a taxpayer-funded newsletter a few months before the election that included this simple observation:

    "Convicted felons can vote," she said, if "your" prison sentence has been served, parole or probation completed and fines paid. While campaigning, McKinney, who is black, noted that blacks make up a disproportionately large share of the prison population, which she said dilutes their voting strength.

    A dozen House members spent more than $133,000 each to send 9.8 million pieces of mass mailings. Total cost? $1.8 million.

    Sometimes the lawmakers' taxpayer funded mailings topped what they paid for direct mail through their campaign funds.

    Of the 64 House members with at least $100,000 in taxpayer-funded mailing expenses _ and overwhelmingly for mass mailings _ 42 were Republicans and 22 were Democrats, the AP review found.

    In sharp contrast, 59 lawmakers in the 435-member House _ 35 Republicans and 24 Democrats _ spent nothing on mass mailings. They tended to be the more experienced House members, often with 14 or more years of service.

    Mass mailings cannot be blatantly political, but they still can have political benefits, said Pete Sepp, a spokesman for the National Taxpayers' Union, which has condemned mass mailings.

    "A taxpayer-financed mailing doesn't have to say 're-elect me' to have an impact on voters," Sepp said. "A glossy newsletter splashed with the incumbent's achievements in Congress can build useful credentials a lawmaker can take with him to the ballot box. The franking privilege is one of the main cogs in Congress' PR machine."

    Franking, practiced since the early days of the republic, lets members of Congress send mail with just a signature where the postage would normally be affixed. Although the mailings are regulated by a congressional commission to guard against overt political appeals and cannot go out within 90 days of an election, they still sometimes take a dig at the opposition.

    In a June 2006 newsletter, Rep. Pete Stark, D-Calif., noted that under the Republican majority, Congress had passed tax cuts that "benefit the wealthiest Americans at the expense of working families."

    Stark has been a regular among the biggest users of the congressional franking privilege. For 2006, his mass mailings alone cost $172,357, an amount large enough to rank him among the top congressional mailers. House documents reported his overall mailing costs to be about $37,000 less. The AP received no explanation for the apparent discrepancy from spokesmen for Stark, the House Administration Committee and House administration staff.

    Some lawmakers defend the newsletters as a vital way of communicating with constituents.

    "One of the biggest complaints my constituents had (with) my predecessor was that they never knew what was going on in Washington," said Rep. Ginny Brown-Waite, R-Fla. "They never had the opportunity to do surveys, etc. I promised I would communicate with them regularly."

    Brown-Waite is one of the biggest users of bulk mail, with 657,951 pieces at a cost of $129,428 last year. That surpassed the approximately $110,000 her campaign spent on direct mailings and related costs.

    One taxpayer-funded mailing featured a picture of her and the headline: "Medicare Prescription Drug Update: The Time to Act is Now." Another, entitled "Constituent Service Guide for the 5th District," included a survey and information about how to obtain U.S. flags, assistance from federal agencies and an appointment to a military academy.

    The House Democratic Caucus encourages members to use the mailings to communicate with constituents, spokeswoman Sarah Feinberg said. She said it was a good way for congressmen to focus on an issue or, if survey questions are used, get a handle on what constituents are thinking.

    That argument doesn't persuade Rep. Ray LaHood, R-Ill., who said he has never used the mailings in 13 years in Congress. "It's a waste of taxpayers' money," he said. "I don't believe in this self-promotion."

    LaHood argues that franking should be used only to answer constituent mail. He has repeatedly introduced bills to ban mass mailings and just as often the legislation dies in committee.

    For the House and Senate combined, the cost of taxpayer-paid mailings, including mass mailings, letters to individuals and groups of up to 500 people, was $34.3 million for fiscal year 2006, according to a recent Congressional Research Service report. In 1988, before more restrictions were imposed on the use of mailings, the figure was more than three times larger, $113.3 million.

    The biggest senders in the AP analysis included freshmen in tight re-election fights and veterans who coasted to victory.

    Rep. Henry Brown, R-S.C., had the most pieces of mass mailings: 1,257,972. His mass mailings' cost of $171,286 was among the highest in the House, as was the overall cost of his franked mail, at $177,706.

    Murphy, who advised constituents to maintain cars, was one of the House leaders in sending out bulk mail, with 1,003,836 pieces. The price tag: $165,650.

    Among legislative leaders, the biggest spender was Rep. Thaddeus McCotter, R-Mich., who last fall became chairman of the House GOP Conference. He spent $133,053 to mail 844,336 pieces.

    Other leaders in the last Congress and the current one were not big users.

    The cost of postage is not the only expense for taxpayers. Printing and reproduction can add tens of thousands of dollars to a mailing's cost. The printing cost for one mailing from McCotter was $30,259.

    There is a practical limit on how much can be spent on mailings.

    Funding comes from a congressman's office budget, which ranges from $1.2 million to $1.4 million for payroll and other expenses. The more spent on mass mailings, the less money is available for such needs as staff, salaries and district offices.

    Senators can also send franked mail, but the amount for each senator is specific and generally based on the number of addresses in a senator's state. At no point may it exceed $50,000 a year for mass mailings. For fiscal year 2004, overall mail allocations ranged from $31,746 to $298,850.

    Rep. Cliff Stearns, R-Fla., who mailed 906,788 pieces last year and won re-election with 60 percent of the vote, sees the mailings as helping him do his job.

    "Ours is a representative government, requiring an active dialogue between elected officials and those they serve," Stearns said in a statement.

    Mike Stokke, a political aide to recently resigned Rep. Dennis Hastert, R-Ill., when he was House speaker, said he would advise congressmen to send out mailings when they've fulfilled an important promise, such as getting money for a bridge in the district.

    I find it irritating that every now and then, some tom dick and harry comes to these forms and say - "time to close down" whenever you see something that you don't like. Frankly, this shallow view and negative attitude is irritating.
